Art. 1 — Subject matter
These General Terms and Conditions (GTC) govern the relationship between CréditPro SA, a credit broker with registered office at Rue du Rhône 14, CH-1204 Geneva (hereinafter "CréditPro"), and any natural person (hereinafter "the Client") using the credit brokerage services offered through creditpro.ch.
CréditPro acts as an independent broker between the Client and partner financial institutions. It is not a lending institution and does not itself grant credit.
Art. 2 — Services offered
CréditPro provides the following services:
- Analysis of the Client's financial situation
- Search and comparison of credit offers from Swiss banking partners
- Submission of the credit file to partner institutions
- Support throughout the credit application process
- Free online simulation tools
The brokerage service is free of charge for the Client. CréditPro is remunerated by partner financial institutions upon conclusion of a credit contract.
Art. 3 — Eligibility conditions
To access CréditPro's services, the Client must:
- Be an adult natural person (18 years of age or older)
- Be legally resident in Switzerland (legal domicile, permit C, B or equivalent)
- Have a stable and regular income
- Pass the creditworthiness check required by Art. 3 LCC
Under Art. 3 LCC (RS 221.214.1), CréditPro systematically verifies the creditworthiness of every applicant before transmitting any contractual offer. This check involves consulting ZEK and CRIF databases, with the Client's explicit consent.
Art. 4 — Interest rate and APR
The Annual Percentage Rate (APR / TAEG) applicable to credit arranged by CréditPro is 2.0% fixed. This rate is:
- Guaranteed from the date of signing the credit agreement
- Fixed for the entire duration of the contract
- Unchanged regardless of market conditions
- All-inclusive — no additional hidden costs
No arrangement fee and no file fee are charged to the Client for the brokerage service.
Art. 5 — Right of withdrawal (Art. 16 LCC)
Under Art. 16 LCC (RS 221.214.1), the Client has a right of withdrawal of 14 calendar days from the date of signing the credit agreement. This right may be exercised without justification and without penalty, by written notice to CréditPro SA.
Upon withdrawal, the Client must return within 30 days any capital already received, plus interest accrued pro rata for the period of use.
Art. 6 — Early repayment (Art. 17 LCC)
Under Art. 17 LCC (RS 221.214.1), the Client is entitled to make a full or partial early repayment of the credit at any time. In such case:
- Interest is recalculated pro rata for the period actually covered
- No excessive penalty is applied
- The lending institution may retain interest corresponding to a maximum period of two months
Art. 7 — Data protection
The processing of the Client's personal data is governed by our Privacy Policy, compliant with the nFADP (RS 235.1). Data is hosted exclusively in Switzerland and is not sold to third parties.
Art. 8 — Limitation of liability
CréditPro is not responsible for credit decisions made by partner financial institutions, nor for the rejection of any credit application. The results of online simulators are for indicative purposes only and do not constitute a binding contractual offer.
Art. 9 — Jurisdiction and applicable law
These GTC are governed by Swiss law. In the event of any dispute, the exclusive jurisdiction shall be that of the courts of Geneva. The mandatory consumer rights provided for under the LCC and the Swiss Code of Obligations shall remain applicable in all circumstances.
Art. 10 — Amendments to the GTC
CréditPro reserves the right to amend these GTC at any time. Amendments will be communicated to Clients at least 30 days in advance by e-mail or website publication. Continued use of the services after that period constitutes acceptance of the new terms.
Legal notice (Art. 36 LCC) — Credit is a commitment and must be repaid. Check your repayment capacity before committing. CréditPro SA is a credit broker subject to the Swiss Consumer Credit Act (LCC, RS 221.214.1) and the Swiss Code of Obligations.
